The full terms below are what count.
01About these terms
These terms cover custom work that I, Tommy (deargod, at deargod.dev), make for you, such as Twitch extensions, overlays, Discord bots and websites. "You" means the person or business ordering the work.
By asking for a quote or paying for work, you agree to these terms. If a written quote I send you says something different, the quote applies to that project.
02Quotes and prices
Prices on this site are starting prices in USD. Your final price depends on what you need, and I'll set it out in a written quote before any work starts.
A quote is valid for 14 days. Anything not in the quote, such as a new feature, needs a new quote.
03Payment
Work starts once you've paid a 50% deposit. The rest is due when the work is finished, before I hand over the final files.
I'll tell you which payment methods I accept with your quote. Any fees your payment provider charges you are yours.
04Delivery times
Delivery times count from when I've received your deposit and everything I need from you, such as your brief, logos and other files.
Rush delivery roughly halves the delivery time for the extra fee shown with each package.
If feedback or files from you arrive late, the delivery date moves back by the same amount. If I'm going to be late for reasons on my side, I'll tell you as soon as I know.
If I miss the agreed delivery date by more than 7 days for reasons on my side, you can cancel and get back everything you've paid for work you haven't received, including your deposit.
05Revisions
Each package or quote includes 1 round of revisions, unless the quote says otherwise: changes to the delivered work that stay within the agreed brief.
Each extra round costs $10 and adds 1 day to the delivery time.
Changes outside the brief, such as new features or a different design, count as new work and need a new quote.
06What I need from you
To deliver on time, I need:
- A clear brief, and answers to my questions within a few days.
- Any logos, images, fonts or other files you want used. You must own them or have permission to use them.
- Any access needed to set up or test the work, such as a Twitch test channel or a Discord test server.
07Twitch, Discord and other platforms
Twitch extensions have to pass Twitch's own review before they go live. I build to Twitch's published requirements, but approval is Twitch's decision, so I can't guarantee it.
If Twitch rejects an extension because of something in my work, I'll fix it at no extra cost. Changes needed because of your content, or because Twitch changes its rules after delivery, count as new work.
You're responsible for following Twitch's terms when you use the work. Some extensions need a server or other paid services. Those costs are yours, and I'll point them out in the quote.
Discord bots run under Discord's developer terms. I build to them, and you're responsible for how the bot is used in your server. A bot needs hosting to stay online. Any hosting costs are yours, and I'll explain the options in the quote.
Websites need a domain and hosting to stay online. Those costs are yours, and the domain and hosting accounts should be in your name. You're responsible for what you publish on the site.
08Ownership and use
Once you've paid in full, you own the final work I made for you and can use it however you like. Until then, it stays mine and you can't use it in public.
I keep the rights to my own tools, code and know-how that I reuse across projects. You get a permanent licence to use them as part of your work. Third-party parts, such as fonts or open-source code, stay under their own licences.
I may show the work in my portfolio, including on this site, unless you ask me not to in writing before the work starts.
09Cancellations and refunds
You can cancel at any time by telling me in writing.
If you cancel before I've started, I'll refund your deposit in full. Once I've started, I keep the deposit to cover the work done so far. If I've done more than the deposit covers, I'll charge for that work, never more than the quoted price.
If I cancel, or can't finish the work, I'll refund everything you've paid for work you haven't received.
10After delivery
For 14 days after delivery, I'll fix bugs in my work for free. A bug is when the work doesn't do what we agreed.
This doesn't cover problems caused by changes someone else makes, by your own setup, or by updates to Twitch, Discord or other services after delivery. I can help with those as new work.
11Liability
I'll do the work with reasonable care and skill.
My total liability for a project is limited to the amount you paid for it. I'm not liable for indirect losses, such as lost income, viewers or sponsorships.
Nothing in these terms limits rights you have by law that can't be limited, or my liability for anything the law doesn't let me exclude.
12Confidentiality
We'll both keep each other's private information, such as unreleased plans, login details and pricing, confidential, unless we agree otherwise or the law requires it.
If you give me logins or keys to set up the work, I'll only use them for your project. Change them once the work is done.
13Everything else
We'll agree the details of each project, such as the quote, changes and sign-off, in writing. Email and Discord messages count.
I may update these terms. The version in place when you accept a quote applies to that project.
These terms are governed by the law of England and Wales.
